摘要:當前,在復雜的經濟環境下,就業歧視問題層出不窮,并有越演越烈的趨勢。就業歧視,導致勞動者的平等權利得不到保障,擾亂了經濟市場的秩序,激化了社會矛盾,阻礙了社會的和諧發展。本文通過分析完善反就業歧視立法的理論意義和實踐意義,指出現行反就業歧視立法存在的缺陷,包括法律界定不明確,責任承擔機制缺失,反就業歧視機構缺位,以及法律救濟途徑有限等問題。本文在借鑒英美對于反就業歧視問題解決制度的基礎上,對我國反就業歧視立法提出相關完善建議。 關鍵詞:反就業歧視;公平就業;勞動者;用人單位
Abstract:At present, in a complex economic environment, the problem of employment discrimination endless, and has intensified the trend. 中國當下主要的情況就是就業環境還沒有完全的形成,良好的就業秩序需要我們不斷的去努力,去改善。中國是一個勞動力非常豐富的市場,如果在勞動力資源上不能合理利用,造成的浪費是顯而易見的,因此,上述的研究也為中國將來社會秩序的穩定和經濟的飛速發展奠定良好的基礎,至少大多數人還是會相信,將來會越來越好,會越來越公平,平等。
